Liliany Obando is granted conditional bail!

After a seven month wait, human rights defender Liliany Patricia Obando Villota was finally granted conditional bail on the 24 February 2015. She has been under house arrest for the last six months in spite of having fulfilled all the requirements to be granted bail.


The judge decreed however that Liliany's bail would only become effective following payment of $3.2 million Colombian pesos, equivalent to US$ 1,200 and would be subject to a probation period of 8 months and 19 days, which is the time left on her illegitimate sentence.

Liliany, a recognised Sociology lecturer and human rights defender, was first imprisoned between August 2008 and March 2012, accused of links to FARC guerrillas. She was detained for 43 months without a conviction before being released and then later sentenced to 70 months in prison, the rest of which she could serve under house arrest. She was also handed an astronomical fine of $US 370,000.


In spite of having fully complied with all of the terms of her release from prison, before the house arrest was implemented, she was imprisoned again on the 5th August 2014. After enduring a period of 15 days in prison and staging a six day hunger strike, Liliany was returned home to serve out her house arrest.


For Liliany to be granted conditional bail now, seven months later, is a small but important victory and this has been achieved thanks to the national and international solidarity that has been shown to Liliany at all times. Over the last seven months huge efforts have been made including a massive campaign to send her letters of support and the intervention of trade unions, human rights lawyers and numerous parliamentarians on her behalf.


Justice for Colombia will continue to support Liliany and campaign for justice on her behalf until she obtains her freedom, which at the moment will not be for another 8 months and 19 days, and after the exorbitant six-figure fine imposed as part of her sentence is removed.

Nuestro compa√Īero de prisi√≥n y miembro del (MNC), desde el d√≠a 25 de febrero inicio una justa huelga de hambre exigiendo del Estado colombiano se le conceda la libertad inmediata toda vez que es inocente de todos los cargos imputados; "Soy v√≠ctima de un falso positivo judicial". El reo, ha venido agotando todo tipo de tr√°mites judiciales, presentando pruebas fehacientes y tangibles que demuestran su inocencia pero la respuesta es siempre negativa y tiene que seguir injustamente privado de su libertad, le ha escrito a presidencia, fiscal√≠a, jueces, tribunales, etc., siempre obteniendo la misma respuesta. Debido a esto la soluci√≥n del sistema ha sido llevarlo a medicina legal, y ante un psiquiatra con la maquiav√©lica intenci√≥n de declararlo loco, inimputable.

Por estas razones ya expresadas nuestro compa√Īero tom√≥ la dif√≠cil decisi√≥n de comenzar una huelga de hambre exigiendo su libertad inmediata jornada que no parar√° hasta lograr que se escuche su grito de libertad que a la vez es de dignidad y justicia.

De acuerdo a esto, el (MNC) hace un llamado urgente a la Universidad Manuela Beltr√°n, al Doctor Sigifredo L√≥pez, director fundaci√≥n Defensa de Inocentes, a los juristas del mundo, a los medios masivos y alternativos de comunicaci√≥n, para que se percaten y solidaricen con este caso, as√≠ como impedir que este medio de protesta conlleve a la p√©rdida de la vida de nuestro compa√Īero; en este orden pedimos al INPEC en cabeza del director general, director EPC ERON picota y comando de guardia a no tomar ning√ļn m√©todo represivo contra el huelguista, as√≠ como asistirle con m√©dicos y los respectivos medicamentos para preservar la vida de nuestro compa√Īero.

Como movimiento social tras los muros, también solicitamos a los negociadores de paz en la Habana Cuba, solidarizarse con el tema y enviar un delegado para que indague de primera mano este emblemático caso.

Guardia del INPEC incita a presos políticos y de guerra a la huelga

Contin√ļan los macabros m√©todos de la guardia del INPEC contra los prisioneros pol√≠ticos y de guerra en condici√≥n de discapacidad, uno de ellos es no llevarlos a la remisi√≥n m√©dica, agravando m√°s su estado de salud. ¬†
 
El día 27 de noviembre del 2014, los prisioneros políticos y de guerra de las FARC-EP, confinados en la cárcel de ERON picota nos lanzamos a huelga de hambre como medio de ser escuchados y que nuestros camaradas graves de salud atendidos; a raíz de esto hubieron acuerdos por escrito donde las partes se comprometían a cumplir las atenciones y tratamientos en salud. A estos acuerdos se les ha venido haciendo un seguimiento donde en gran parte se han cumplido; pero vemos con preocupación lo siguiente:   
 
El camarada ISAAC ARIAS LOPEZ con TD 71920 y C.C. 6597785  el cual presenta herida de guerra, el día 6 de febrero tenía remisión a ortopedia urgente, la cita era en la 100 con 74, torre de especialistas de SALUCOOP EPS, nosotros notificamos con 15 días de anterioridad al INPEC, para que se realizara esta remisión; se habló con sanidad INPEC quedando constancia con ellos de que la remisión era para el 06 de febrero con el ortopedista. Hoy Arias tenía programada cita para operación de retirada de clavo intramedular, ordenada por el especialista Sergio Tejerina Delgado, de SALUCOOP EPS, donde con 15 días de anterioridad se le notificó al encargado de remisión.  Desde el día lunes 23 este prisionero de guerra presentó demasiado dolor de columna y pierna derecha, desde hace 8 días presenta coloración roja de la piel, de abajo hacia arriba hasta la altura de la rodilla.      
 
Hoy nuevamente pierde la cita con el especialista. Debido a su gravedad fue sacado por sus compa√Īeros el d√≠a de hoy en la tarde al √°rea de urgencia de sanidad, donde fue valorado por la¬† m√©dica Viviana Riveros, donde se orden√≥ la remisi√≥n por urgencia para el hospital de SALUCOOP de la 104 para el d√≠a 25 de febrero, notificando de inmediato a la guardia de Remisiones. ¬†
 
Nuestro camarada Isaac Arias, tiene EPS particular "régimen contributivo", el INPEC ni ninguna entidad deben pagar nada, solo deben llevarlo a las citas médicas, y es allí donde vemos la grave problemática, todo porque la guardia de este penal en cabeza del capitán Chávez como jefe de remisiones, hace lo que se le viene en gana, pasa por alto las ordenes ya firmadas por el director del penal, una orden con cita médica, todo como método de tortura contra nuestros camaradas, es allí donde está la problemática, pues de nada sirve que un médico ordene citas, cirugías y demás si la guardia del INPEC no los lleva.    
 
En este orden de ideas, emitimos S.O.S. a nuestra Delegaci√≥n de Paz en La Habana Cuba, en√©rgico llamado al Gobierno Nacional,¬† a las autoridades disciplinarias y entes de control correspondientes, al INPEC para que se investigue a los funcionarios que incurren en hechos de violaci√≥n al DIH. Igualmente solicitamos todo el apoyo y solidaridad de los diferentes sectores sociales para que no se contin√ļe con estos hechos que solo incitan a la violencia.

History of an infamy.

Translators’ Note: David Ravelo, arrested on September 14, 2010 and imprisoned in La Picota Prison in Bogota, is serving an 18-year sentence. Appeals have failed, although Colombia’s Supreme Judicial Court is considering his case now. His words below attesting to his lifelong project of defending human rights speak the truth. He served as a municipal official in his native Barrancabermeja for the leftist Patriotic Union coalition beginning in the late 1980’s. He led resistance to paramilitary killings and massacres besieging the city for years prior to his arrest. Ravelo headed Barrancabermeja’s Credhos human rights group which he helped found; nine Credhos leaders have been assassinated. Ravelo is a member of the Colombian Communist Party’s Central Committee.

Ravelo was instrumental in implicating Mario Jaimes Mej√≠a, alias ‚ÄúEl Panadero,‚ÄĚ as the lead organizer of paramilitary attacks in the Barrancabermeja area. He is the ‚Äúfalse witness‚ÄĚ noted below. As deadly persecution of the Patriotic Union was reaching its peak, Ravelo was imprisoned in 1993-1995 - on false charges.

In June, 2007 the reporter Gerardo Reyes of the Miami Herald newspaper called me from the United States and told me about a video showing President Alvaro Uribe Vélez meeting in Puerto Berrío (Antioquia) with several paramilitaries from Barrancabermeja. He had the video sent to me telling me also he had spoken with several people and no one dared to denounce what it showed. In the middle of June, of the same year, I denounced that secret meeting before the mass media at a national level. From then on, ferocious persecution was unleashed against the present writer  

On February 11, 2008, MAPP (OEA) [Mission in Support of the Peace Process of the Organization of American States] informed me I was being followed by a paramilitary commando wanting to assassinate me. The government asked me to leave Barrancabermeja, an action I rejected inasmuch as the state is supposed to guarantee protection of human rights for citizens and for defenders of human rights.

On February 17, 2011 MAPP (OEA) again approached me with a warning. Now they were certain that that paramilitary group was going to make an attempt against my person with a high-power explosive device placed inside my home. We denounced this before national and international organizations. I myself felt obliged to leave the city.

Changing strategy and seeming to leave off physical assassination, the murderers took to persecution and judicial assassination. Thus it was that on April 17, 2008, in the prison in Itag√ľ√≠ (a national factory for judicial fakery), the confessed criminal Mario Jaimes Mej√≠a, alias ‚ÄúPanadero,‚ÄĚ speaking under the auspices of Justice and Peace(1)told about a non-existent meeting in the year 1991 supposedly to prepare for the killing of engineer David N√ļ√Īez Cala. The criminal stated that the present writer had participated in that meeting with former congressperson Ar√≠stides Andrade.¬†

Prosecutor Three in Barrancabemeja took on the investigation and on finding no proof or reason tying me to the process, he decided to disassociate me from the investigation. But suspiciously the Attorney General of the era, Mario Iguar√°n Arana, on March 25, 2009 transferred the process from Barrancabermeja to Bogot√°.

On July 31, 2009, the last day Iguar√°n was serving as attorney general, he assigned the process to Anti-terrorism Prosecutor 22, William Gildardo Pacheco Granados. And he did this without any previous investigation and in disregard of the action taken by the Barrancabermeja prosecutor. Immediately he put me under investigation. From this time on, there came into being an entire ocean of arbitrary actions with violations of due process and the right to defense, and along with it the macabre alliance with the false witness, alias ‚ÄúEl Panadero.‚ÄĚ To prove it, investigator Jairo Salazar Medina, on two occasions, removed Mr. Fremio S√°nchez Carre√Īo, another false witness, from patio six of Picota prison to Patio ERE 3, of Justica and Peace, which is located away from the main prison. There, he could meet with alias ‚ÄúEl Panadero‚ÄĚ and get himself oriented with the set-up directed at muddying the name of David Ravelo Crespo. That was the reason why these criminals delayed the investigation, so that they could meet and put themselves in agreement with the set-up as they saw it, all with the intervention of Jairo Salazar Medina of CTI (Technical Investigation Team) and criminal prosecutor William Gildardo Pacheco Granados.

The main proof the Prosecutor had was a photo of several people appearing with FARC insurgents during a peace process, and, according to alias ‚ÄúEl Panadero,‚ÄĚ David Ravelo was there in that photo. On several occasions alias ‚ÄúEl Panadero,‚ÄĚ offering a physical description of David Ravelo, affirmed not that his face was thin, which it is, but that he was tall and dark-complexioned. Clearly he did not know me; it became clear that reporter Miguel √Āngel Rico Garc√≠a of the Liberal Vanguard newspaper was there in the photo. He was covering those talks. Doctor Horacio Serpa Uribe, the priest Jaime Barba Rinc√≥n, and the photographer Jes√ļs Villamizar Rodr√≠guez who took the picture, all of whom participated in that meeting [with the FARC], confirm that the person appearing in the photo is the journalist Miguel √Āngel Rico Garc√≠a. That gives the lie to what the false witness ‚ÄúEl Panadero‚ÄĚ said.

The effrontery of this set-up became clear when William Pacheco as prosecutor, and Jairo Salazar Medina as investigator, moved the youth named Fernando Barbudo Ch√°vez to patio six of La Picota prison so he could testify against David Ravelo. But when my lawyer Alirio Uribe cross-examined that false witness, he found out that person was only nine years old when the events they connected me with actually occurred, thus placing the crude set-up in evidence.

Another important element is that the judge named to continue with the process was an administrative judge, and unexpectedly he was switched for a temporary judge who took exclusive charge of my case. This person acted like a ‚Äúcaballo perchero,‚ÄĚ as they say; he was only thinking about convicting me. He disregarded the documentary evidence and testimony related to the proceedings. He based his decision solely only on testimony of the two false witnesses.

The sea of irregularities does not stop there: then it was discovered that prosecutor William Gildardo Pacheco Granados could not and ought not carry out that function because as a national police lieutenant, on March 6, 1991, in the city of Armenia, he forcibly disappeared the youth Guillermo Hurtado Parra, an atrocious act verified by the national inspector general’s office that removed him. That decision remained in force even after appeal. A military criminal justice court convicted him; he appealed at every level of Colombian justice system like the Supreme Court of Justice, the Constitutional Court, and the Council of State. They confirmed his removal on account of the forced disappearance, a crime against humanity; that is to say, it’s firmly established that this criminal who carries on as a prosecutor did disappear the youth Guillermo Hurtado Parra.

What a paradox! Someone violating human rights, like William Gildardo Pacheco Granados, is investigating a defender of human rights. What guarantees could he offer in the process? Obviously none! This was the regular judge who investigated me even though Law 270 of 1996 (Judiciary Statutes), article 150, numbers five and six, textually says that whoever is removed for disciplinary reasons or convicted on criminal charges may not exercise any responsibility in the judiciary system. And this was the jewel who had me put in prison, despite false evidence and him having the legal problem of the specific disqualification imposed on him by the Inspector General’s Office. Another odd fact has to do with investigator Jairo Salazar Medina who in 1988 was functioning as a lieutenant in the Army in Barrancabermeja. There, on January 15 of that year, non-commissioned army officer Francisco Pérez assassinated USO union leader Manuel Gustavo Chacón Sarmiento for which he received a 16-year prison sentence. And the killer’s immediate superior officer when these events took place was Jairo Salazar Medina.

El Tiempo newspaper on March 6, 1992 published as criminal news the report that Mr. Jairo Salazar Medina had been removed from the National Army for mismanaging a revolving fund. Another paradox: This subject kept on with his functions as a member of the CTI of the National Attorney General’s office. It was he who pushed ahead with the investigation against me and was quite unfit to do so.

What remains clear here is a triangle from the ‚Äúcriminal underworld‚ÄĚ where evil doing brings these three personalities together to elaborate a set-up and cost me a whole life of defending human rights. They utilize the lie as their favorite weapon and they trample truth underfoot. ¬†It‚Äôs very clear I was convicted without proofs and all due to an unlawful interest in having me in prison in order to remove me from the public scene as a defender of human rights.

I have publically insisted, and with all respect, that the relatives of engineer David N√ļ√Īez Cala who was basely murdered, have every right to demand and know the truth so that justice that is due, and founded on the truth, might be applied to this unpardonable crime - not the faked truth, the false truth, as orchestrated by a criminal prosecutor like William Gildardo Pacheco Granados and by false witnesses like the confessed criminal Mario Jaimes Mej√≠a, alias ‚ÄúEl Panadero.‚ÄĚ Among other things, it‚Äôs also fully proven that this subject from prison ordered the kidnapping and violation of the distinguished journalist Jineth Bedoya. This was an atrocious act that he never confessed in the Justice and Peace process; that is to say, he lied, as is his custom.

Furthermore, he has a criminal process ongoing now on account of his having ordered from prison the assassination of the rector of the 26th of March School in Barrancabermeja. There are so many other facts demonstrating the capacity of this subject for lying that the Prosecutor surely knows of his modus operandi.

This faked process is full with an ocean of lies; it‚Äôs been said against me that there exists ‚Äúan extensive body of evidence.‚ÄĚ That‚Äôs false, totally false: there only exists the declarations from the two false witnesses; these are the supposed ‚Äúproofs.‚ÄĚ There is nothing else. On the contrary, the broadest possible evidence exists, documents and testimony alike, establishing my innocence.

In a perverse way, they are trying to question my activity as a defender of human rights as they assert: ‚ÄúDavid Ravelo, supposed defender of human rights never had threats against him nor did he do anything that brought any risk onto himself.‚ÄĚ This is a mean-spirited, deceitful affirmation that disregards the collective memory of the community of Barrancabermeja where I dedicated a big part of my life to defending human rights. That was evident when on September 9, 2009, the present writer was awarded the order of San Pedro Claver of the Diocese of Barrancabermeja for a life entirely dedicated to the defense of human rights.

With tenacity and dignity, defying the risk and overcoming the affronts, I have resisted all the persecution I have been subjected to for defending the noble cause of human rights. To these liars I throw back at them the words of the philosopher Lucio Anneo S√©neca, who affirmed, ‚ÄúMany lie to deceive and others because they are deceived.‚ÄĚ

I have always said that the stem of truth bends but never breaks. The moment will come in which the truth is going to watch over all that macabre scheme and put the role of false witnesses into evidence, because, among other things, the Attorney General of the Nation himself has introduced charges for procedural fraud together with false testimony against the false witness Mario Jaimes Mej√≠a alias ‚ÄúEl Panadero.‚ÄĚ The Attorney General thus verified that this criminal lied in the proceedings in my case.

On the most recent February 9, of this year, the Ninth Criminal Circuit Court of the city of Bucaramanga endorsed the accusation presented by the Specialized Third Prosecutor of the National False Witnesses Unit. An exhaustive examination had been made of testimonial evidence from Luis Orrego, Pedro Gilberto Ni√Īo Pardo, Jorge Valencia, Orlando Noguera, Fernando Barbudo Ch√°vez, and Jes√ļs Villamizar Rodr√≠guez. Through their testimonies they explained how the crude set-up had been hatched. Therefore, the innocence of David Ravelo Crespo and Jos√© Ar√≠stides Andrade is demonstrated absolutely.

It was shown that the only two ‚Äútestimonial proofs‚ÄĚ against me are false. Now what legal reasons are there for the present writer to keep on being imprisoned for a crime he never committed?

But it‚Äôs also necessary to mention that the criminal prosecutor William Gildardo Pacheco Granados was linked criminally to the process by virtue of the forced disappearance of the youth Guillermo Hurtado Parra, in particular by the sixth and seventh Specialized Prosecutor who ruled on forced disappearance as a crime against humanity. So it‚Äôs clear that this ‚Äúregular judge‚ÄĚ who sent me to prison lacked jurisdiction to do so because he was unqualified. He was the one who directed the entire set-up against the present writer, creating all this tangle of lies in order to imprison me unjustly.

I will keep on utilizing all possible petitions nationally and internationally (e. g. the Inter-American Human Rights Commission of the OAS) in order to make clear my full innocence and keep on telling the national and international community that in spite of the torment I have been subjected to, I continue with my head high. And from prison I am fulfilling my activities I have carried out all my life as a defender of human rights. To exercise that noble and praiseworthy activity in this country entails taking on risk. I will continue to do so. And I am sure that at the end of the road, the light of truth will shine with all its brilliance. We will overcome the ignominy to which I have been subjected, because the truth surely will make me free.

Historia de una infamia. Por David Ravelo Crespo, preso político e inocente, víctima de un montaje criminal 15 Febrero 2015

En el mes de junio del a√Īo 2007, el periodista Gerardo Reyes del Diario Miami Herald, me llam√≥ de Estados Unidos y me habl√≥ de un video donde aparec√≠a el presidente √Ālvaro Uribe V√©lez, reunido en Puerto Berr√≠o (Antioquia) con varios paramilitares de Barrancabermeja, me hizo llegar el video y me inform√≥ que hab√≠a hablado con varias personas y ninguna se atrevi√≥ a denunciar ese hecho. A mediados de junio de ese mismo a√Īo denunci√© esa reuni√≥n secreta ante los medios de comunicaci√≥n a nivel nacional; a partir de ese momento se desat√≥ contra el suscrito una feroz persecuci√≥n.¬†

El 11 de febrero de 2008, la MAPP (OEA), me informó que un comando paramilitar, me estaba haciendo seguimiento para asesinarme; el gobierno me solicitó que abandonara Barrancabermeja, hecho que rechacé porque el Estado es quién debe garantizar la protección y garantía de los Derechos Humanos a los ciudadanos y a los defensores de Derechos Humanos. 

El 17 de febrero de 2011, nuevamente la MAPP (OEA) me abordó para prevenirme, ya que tenían la certeza que ese grupo paramilitar iba a atentar contra mi integridad física colocando un artefacto de alto poder explosivo en mi sitio de residencia. Denunciamos el hecho a los organismos a nivel nacional e internacional, viéndome obligado a salir de la ciudad. 

Los asesinos cambiaron de estrategia y parece que desistieron del asesinato f√≠sico y emprendieron la persecuci√≥n para ejercer el asesinato judicial. Es as√≠ como el 17 de abril de 2008, en la c√°rcel de Itag√ľ√≠ (F√°brica nacional de montajes), el delincuente confeso Mario Jaimes Mej√≠a, alias ‚ÄúEl Panadero‚ÄĚ, habl√≥ en Justicia y Paz de una falsa reuni√≥n en el a√Īo 1991, supuestamente para preparar la muerte del ingeniero David N√ļ√Īez Cala, donde el criminal plante√≥ que el suscrito hab√≠a participado en la susodicha reuni√≥n con el ex congresista Ar√≠stides Andrade.¬†

La Fiscalía Tercera de Barrancabermeja asumió la investigación y al no encontrar pruebas ni méritos para vincularme al proceso, tomó la decisión de no vincularme a la investigación porque no existía mérito para ello. Pero de manera sospechosa el Fiscal General de la Nación de la época, Mario Iguarán Arana, el 25 de marzo de 2009, trasladó el proceso de la ciudad de Barrancabermeja para la ciudad de Bogotá.

El 31 de julio de 2009, el √ļltimo d√≠a que Iguar√°n ejerc√≠a como Fiscal General, le asign√≥ el proceso al Fiscal 22 Antiterrorismo William Gildardo Pacheco Granados y este sin ninguna investigaci√≥n previa y desconociendo lo actuado por el Fiscal Tercero de Barrancabermeja, inmediatamente me vincul√≥ a la investigaci√≥n con llamado a indagatoria. A partir de ese momento comenz√≥ todo un mar de arbitrariedades donde se viol√≥ el debido proceso y el derecho a la defensa, y hubo una alianza macabra con el falso testigo alias ‚ÄúEl Panadero‚ÄĚ. Prueba de ello, es que el investigador Jairo Salazar Medina, en dos ocasiones sac√≥ al se√Īor Fremio S√°nchez Carre√Īo, otro falso testigo, del patio siete de la c√°rcel La Picota al patio ERE 3, de Justicia y Paz, que se encuentra en la parte exterior de la c√°rcel, para que se reuniera con alias ‚ÄúEl Panadero‚ÄĚ y se pusieran de acuerdo en el montaje, con el fin de enlodar el nombre de David Ravelo Crespo. Esa fue la raz√≥n por la cual, estos criminales aplazaron la indagatoria con el fin de encontrarse y ponerse de acuerdo en el montaje, como ellos lo reconocieron, todo con la intervenci√≥n de Jairo Salazar Medina del CTI y el Fiscal criminal William Gildardo Pacheco Granados.¬†

La prueba reina que ten√≠a la Fiscal√≠a era una foto en la que aparecen varias personas con la insurgencia de las FARC en un proceso de paz, y seg√ļn alias ‚ÄúEl Panadero‚ÄĚ, David Ravelo aparec√≠a all√≠ en esa foto. Por eso en varias ocasiones alias ‚ÄúEl Panadero‚ÄĚ al dar la descripci√≥n f√≠sica de David Ravelo afirm√≥ que no era cara file√Īa, era alto y moreno: Estaba claro que no me conoc√≠a; se demostr√≥ que quien aparec√≠a en la foto era el periodista Miguel √Āngel Rico Garc√≠a del peri√≥dico Vanguardia Liberal, que se encontraba cubriendo dichos di√°logos. El doctor Horacio Serpa Uribe, el sacerdote Jaime Barba Rinc√≥n y el fot√≥grafo Jes√ļs Villamizar Rodr√≠guez quien tom√≥ la foto, quienes participaron en dicha reuni√≥n, confirmaron que la persona que aparece en la foto es el periodista Miguel √Āngel Rico Garc√≠a, desmintiendo lo afirmado por el falso testigo alias ‚ÄúEl Panadero‚ÄĚ.¬†

El descaro de este montaje se evidenci√≥ cuando William Pacheco como Fiscal, y Jairo Salazar Medina como investigador, ubicaron en el patio siete de la c√°rcel La Picota, a un joven llamado Fernando Barbudo Ch√°vez, para que declara en contra de David Ravelo, pero cuando mi abogado Alirio Uribe, contrainterrog√≥ a ese falso testigo descubri√≥ que esa persona para la fecha de los hechos que me acusan, ten√≠a solamente nueve a√Īos de edad, quedando en evidencia el burdo montaje.¬†

Otro elemento importante es que la Juez nombrada para llevar el proceso era de carrera administrativa y de manera inesperada fue cambiada por una Juez temporal que se encargó exclusivamente de mi caso. Esta persona actuó como un caballo perchero es decir, solamente estaba pensando en condenarme desconociendo las pruebas documentales y testimoniales que fueron allegadas al proceso y solamente basó su decisión en los testimonios de los dos falsos testigos. 

El mar de irregularidades no paro allí: Luego se descubrió que el fiscal William Gildardo Pacheco Granados no podía ni debía ejercer esa función, porque el 6 de marzo de 1991, en la ciudad de Armenia siendo Teniente de la Policía Nacional, desapareció de manera forzada al joven Guillermo Hurtado Parra, hecho atroz que fue comprobado por la Procuraduría General de la Nación que lo destituyó en primera y segunda instancia, y la Justicia Penal Militar lo condenó; esta persona utilizó todas las instancias de la justicia colombiana como la Corte Suprema de Justicia, la Corte Constitucional y el Consejo de Estado que le confirmaron esta destitución por desaparición forzada, crimen de lesa humanidad, es decir está plenamente probado que este criminal que ejercía como Fiscal desapareció al joven Guillermo Hurtado Parra. 

Qu√© paradoja, un violador de los Derechos Humanos como es William Gildardo Pacheco Granados, investigando a un defensor de Derechos Humanos; ¬Ņqu√© garant√≠as pod√≠a brindar en el proceso? obviamente ninguna. Este fue el juez natural que me investig√≥ cuando la Ley 270 de 1996 (Estatutaria de la Justicia) art√≠culo 150, numerales 5¬ļ y 6¬ļ, dice textualmente que quien haya sido destituido disciplinariamente o condenado penalmente, no puede ejercer ning√ļn cargo en la rama judicial y, esta fue la joya que me hizo meter a la c√°rcel, con falsas pruebas y a sabiendas que ten√≠a un impedimento del orden legal, por la inhabilidad especial que le impuso la Procuradur√≠a General de la Naci√≥n.Otro hecho irregular, fue la del investigador Jairo Salazar Medina, quien para el a√Īo 1988 ejerc√≠a como Teniente de la Armada Nacional en la ciudad de Barrancabermeja, donde precisamente el 15 de enero de ese a√Īo, fue asesinado el dirigente sindical de la USO Manuel Gustavo Chac√≥n Sarmiento, por el Suboficial de la Armada Francisco P√©rez, quien fue condenado a diecis√©is a√Īos de c√°rcel por dicho asesinato, siendo el jefe inmediato del asesino para la √©poca de los hechos Jairo Salazar Medina.¬†¬†

El 6 de marzo de 1992, el peri√≥dico el Tiempo public√≥ una noticia criminal en la que se informa que el se√Īor Jairo Salazar Medina, hab√≠a sido destituido de la Armada Nacional por malos manejos en Fondo Rotario. Otra paradoja: Este sujeto sigue ejerciendo sus funciones como miembro del CTI de la Fiscal√≠a General de la Naci√≥n. Fue quien adelant√≥ la investigaci√≥n en mi contra, estando impedido para ello.¬†¬†

Aqu√≠ lo que queda claro, es el tri√°ngulo del ‚Äėbajo mundo delincuencial‚Äô donde el pecado une a estos tres personajes, para elaborar el montaje y cobrarme toda una vida en defensa de los Derechos Humanos, utilizando la mentira como su arma favorita y pisoteando la verdad. Est√° sumamente claro, que fui condenado sin pruebas y solamente exist√≠a el inter√©s il√≠cito de encarcelarme para sacarme del escenario p√ļblico, como defensor de Derechos Humanos.¬†¬†

He manifestado p√ļblicamente y con todo respeto, que los familiares del ingeniero David N√ļ√Īez Cala quien fue vilmente asesinado, est√°n en todo su derecho de exigir y conocer toda la verdad para que se aplique la debida justicia por este irremisible crimen, sobre la base de la verdad real, no la verdad ama√Īada y falsa, orquestada por un Fiscal criminal como lo es William Gildardo Pacheco Granados y unos falsos testigos como lo es el criminal confeso Mario Jaimes Mej√≠a, alias ‚ÄúEl Panadero‚ÄĚ. Que entre otras cosas tambi√©n qued√≥ plenamente probado, que este sujeto desde la c√°rcel mand√≥ a secuestrar y violar a la destacada periodista Jineth Bedoya, hecho atroz que jam√°s confes√≥ en Justicia y Paz, es decir minti√≥ como es su costumbre.¬†¬†

Además, también tiene un proceso penal en curso por cuanto mandó a asesinar desde la cárcel al rector del Colegio veintiséis de marzo de Barrancabermeja. Tantos otros hechos que demuestran la capacidad para mentir de este sujeto, que la Fiscalía conoce de sus modos operandi. 

Este proceso ama√Īado est√° lleno de un mar de mentiras; se ha afirmado que en mi contra existe ‚Äúun acervo probatorio extenso‚ÄĚ falso de toda falsedad: Solamente existen las declaraciones de los dos falsos testigos, esas son las supuestas ‚Äúpruebas‚ÄĚ, no hay m√°s nada, por el contrario existen unas ampl√≠simas pruebas tanto documentales como testimoniales que demuestran mi inocencia.¬†

De manera perversa se ha pretendido poner en tela de juicio mi actividad como defensor de Derechos Humanos al afirmar: ‚ÄúDavid Ravelo supuesto defensor de Derechos Humanos jam√°s tuvo ni amenazas, ni ejerci√≥ actos que promovieran alg√ļn riesgo‚ÄĚ, afirmaci√≥n falaz y mezquina que desconoce la memoria colectiva de la comunidad de Barrancabermeja donde he dedicado gran parte de mi vida a la defensa de los Derechos Humanos, como lo demuestra la orden San Pedro Claver de la Di√≥cesis de Barrancabermeja por toda una vida dedicada a la defensa de los Derechos Humanos, otorgada al suscrito el nueve (9) de septiembre del a√Īo 2009.¬†

Toda la persecuci√≥n a la que he sido sometido, por defender la noble causa de los Derechos Humanos, la he resistido con tenacidad y dignidad afrontando el riesgo y venciendo las afrentas. A estos mentirosos les encaja muy bien las palabras del fil√≥sofo Lucio Anneo S√©neca, quien afirmo: ‚ÄúMuchos mienten para enga√Īar y otros porque est√°n enga√Īados‚ÄĚ.¬†

Siempre he expresado que el tallo de la verdad se dobla pero jam√°s se quiebra, llegar√° el momento en que la verdad va a develar todo ese plan macabro y poner en evidencia el papel de los falsos testigos, porque entre otras cosas, la misma Fiscal√≠a General de la Naci√≥n le ha imputado cargos por fraude procesal en concurso con falso testimonio, al falso testigo Mario Jaimes Mej√≠a alias ‚ÄúEl Panadero‚ÄĚ; la Fiscal√≠a comprob√≥ que este criminal minti√≥ en mi proceso.¬†

El pasado nueve (9) de febrero del presente a√Īo, el Juzgado Noveno Penal del Circuito de la ciudad de Bucaramanga aval√≥ la acusaci√≥n presentada por la Fiscal√≠a Tercera (3¬™) Especializada de la Unidad Nacional de Testigos Falsos, donde hace un examen exhaustivo de las pruebas testimoniales presentadas por: Luis Orrego, Pedro Gilberto Ni√Īo Pardo, Jorge Valencia, Orlando Noguera, Fernando Barbudo Ch√°vez y Jes√ļs Villamizar Rodr√≠guez, quienes con sus testimonios aclaran como se urdi√≥ el burdo montaje y por ende queda absolutamente demostrada la inocencia de David Ravelo Crespo y Jos√© Ar√≠stides Andrade.

Qued√≥ demostrado que las dos √ļnicas ‚Äúpruebas testimoniales‚ÄĚ en mi contra son falsas; ahora ¬Ņcu√°les son las razones legales para que el suscrito siga encarcelado por un delito que jam√°s comet√≠?¬†

Pero tambi√©n es necesario mencionar que el Fiscal criminal William Gildardo Pacheco Granados, fue vinculado penalmente al proceso por desaparici√≥n forzada del joven Guillermo Hurtado Parra, por la Fiscal√≠a Sesenta y Siete Especializada, por el crimen de lesa humanidad que es el de desaparici√≥n forzada, quedando claro que este ‚Äújuez natural‚ÄĚ que me encarcel√≥, no ten√≠a jurisdicci√≥n para ejercer porque no era competente, y fue quien direccion√≥ todo el montaje contra el suscrito, creando toda esta mara√Īa de mentiras para de manera injusta encarcelarme.¬†

Seguiré utilizando todas las instancias del orden nacional e internacional (Comisión Interamericana de Derechos Humanos de la OEA) para dejar clara mi plena inocencia, y decirle a la comunidad nacional e internacional que a pesar del martirio al que he sido sometido, sigo con la frente en alto y desde la cárcel estoy cumpliendo con mis actividades que he realizado toda mi vida, como es la de ser defensor de los Derechos Humanos, porque ejercer esa noble y loable actividad en este país implica asumir un riesgo, lo seguiré asumiendo y estoy seguro que al final del sendero, la luz de la verdad brillará con todo su fulgor y la ignominia a la que he sido sometido la venceremos, por cuanto definitivamente la verdad me hará libre.

Translators’ Note: David Ravelo, arrested on September 14, 2010 and imprisoned in La Picota Prison in Bogota, is serving an 18-year sentence. Appeals have failed, although Colombia’s Supreme Judicial Court is considering his case now. His words below attesting to his lifelong project of defending human rights speak the truth. He served as a municipal official in his native Barrancabermeja for the leftist Patriotic Union coalition beginning in the late 1980’s. He led resistance to paramilitary killings and massacres besieging the city for years prior to his arrest. Ravelo headed Barrancabermeja’s Credhos human rights group which he helped found; nine Credhos leaders have been assassinated. Ravelo is a member of the Colombian Communist Party’s Central Committee.

Ravelo was instrumental in implicating Mario Jaimes Mej√≠a, alias ‚ÄúEl Panadero,‚ÄĚ as the lead organizer of paramilitary attacks in the Barrancabermeja area. He is the ‚Äúfalse witness‚ÄĚ noted below. As deadly persecution of the Patriotic Union was reaching its peak, Ravelo was imprisoned in 1993-1995 - on false charges.

In June, 2007 the reporter Gerardo Reyes of the Miami Herald newspaper called me from the United States and told me about a video showing President Alvaro Uribe Vélez meeting in Puerto Berrío (Antioquia) with several paramilitaries from Barrancabermeja. He had the video sent to me telling me also he had spoken with several people and no one dared to denounce what it showed. In the middle of June, of the same year, I denounced that secret meeting before the mass media at a national level. From then on, ferocious persecution was unleashed against the present writer  

On February 11, 2008, MAPP (OEA) [Mission in Support of the Peace Process of the Organization of American States] informed me I was being followed by a paramilitary commando wanting to assassinate me. The government asked me to leave Barrancabermeja, an action I rejected inasmuch as the state is supposed to guarantee protection of human rights for citizens and for defenders of human rights.

On February 17, 2011 MAPP (OEA) again approached me with a warning. Now they were certain that that paramilitary group was going to make an attempt against my person with a high-power explosive device placed inside my home. We denounced this before national and international organizations. I myself felt obliged to leave the city.

Changing strategy and seeming to leave off physical assassination, the murderers took to persecution and judicial assassination. Thus it was that on April 17, 2008, in the prison in Itag√ľ√≠ (a national factory for judicial fakery), the confessed criminal Mario Jaimes Mej√≠a, alias ‚ÄúPanadero,‚ÄĚ speaking under the auspices of Justice and Peace(1)told about a non-existent meeting in the year 1991 supposedly to prepare for the killing of engineer David N√ļ√Īez Cala. The criminal stated that the present writer had participated in that meeting with former congressperson Ar√≠stides Andrade.¬†

Prosecutor Three in Barrancabemeja took on the investigation and on finding no proof or reason tying me to the process, he decided to disassociate me from the investigation. But suspiciously the Attorney General of the era, Mario Iguar√°n Arana, on March 25, 2009 transferred the process from Barrancabermeja to Bogot√°.

On July 31, 2009, the last day Iguar√°n was serving as attorney general, he assigned the process to Anti-terrorism Prosecutor 22, William Gildardo Pacheco Granados. And he did this without any previous investigation and in disregard of the action taken by the Barrancabermeja prosecutor. Immediately he put me under investigation. From this time on, there came into being an entire ocean of arbitrary actions with violations of due process and the right to defense, and along with it the macabre alliance with the false witness, alias ‚ÄúEl Panadero.‚ÄĚ To prove it, investigator Jairo Salazar Medina, on two occasions, removed Mr. Fremio S√°nchez Carre√Īo, another false witness, from patio six of Picota prison to Patio ERE 3, of Justica and Peace, which is located away from the main prison. There, he could meet with alias ‚ÄúEl Panadero‚ÄĚ and get himself oriented with the set-up directed at muddying the name of David Ravelo Crespo. That was the reason why these criminals delayed the investigation, so that they could meet and put themselves in agreement with the set-up as they saw it, all with the intervention of Jairo Salazar Medina of CTI (Technical Investigation Team) and criminal prosecutor William Gildardo Pacheco Granados.

The main proof the Prosecutor had was a photo of several people appearing with FARC insurgents during a peace process, and, according to alias ‚ÄúEl Panadero,‚ÄĚ David Ravelo was there in that photo. On several occasions alias ‚ÄúEl Panadero,‚ÄĚ offering a physical description of David Ravelo, affirmed not that his face was thin, which it is, but that he was tall and dark-complexioned. Clearly he did not know me; it became clear that reporter Miguel √Āngel Rico Garc√≠a of the Liberal Vanguard newspaper was there in the photo. He was covering those talks. Doctor Horacio Serpa Uribe, the priest Jaime Barba Rinc√≥n, and the photographer Jes√ļs Villamizar Rodr√≠guez who took the picture, all of whom participated in that meeting [with the FARC], confirm that the person appearing in the photo is the journalist Miguel √Āngel Rico Garc√≠a. That gives the lie to what the false witness ‚ÄúEl Panadero‚ÄĚ said.

The effrontery of this set-up became clear when William Pacheco as prosecutor, and Jairo Salazar Medina as investigator, moved the youth named Fernando Barbudo Ch√°vez to patio six of La Picota prison so he could testify against David Ravelo. But when my lawyer Alirio Uribe cross-examined that false witness, he found out that person was only nine years old when the events they connected me with actually occurred, thus placing the crude set-up in evidence.

Another important element is that the judge named to continue with the process was an administrative judge, and unexpectedly he was switched for a temporary judge who took exclusive charge of my case. This person acted like a ‚Äúcaballo perchero,‚ÄĚ as they say; he was only thinking about convicting me. He disregarded the documentary evidence and testimony related to the proceedings. He based his decision solely only on testimony of the two false witnesses.

The sea of irregularities does not stop there: then it was discovered that prosecutor William Gildardo Pacheco Granados could not and ought not carry out that function because as a national police lieutenant, on March 6, 1991, in the city of Armenia, he forcibly disappeared the youth Guillermo Hurtado Parra, an atrocious act verified by the national inspector general’s office that removed him. That decision remained in force even after appeal. A military criminal justice court convicted him; he appealed at every level of Colombian justice system like the Supreme Court of Justice, the Constitutional Court, and the Council of State. They confirmed his removal on account of the forced disappearance, a crime against humanity; that is to say, it’s firmly established that this criminal who carries on as a prosecutor did disappear the youth Guillermo Hurtado Parra.

What a paradox! Someone violating human rights, like William Gildardo Pacheco Granados, is investigating a defender of human rights. What guarantees could he offer in the process? Obviously none! This was the regular judge who investigated me even though Law 270 of 1996 (Judiciary Statutes), article 150, numbers five and six, textually says that whoever is removed for disciplinary reasons or convicted on criminal charges may not exercise any responsibility in the judiciary system. And this was the jewel who had me put in prison, despite false evidence and him having the legal problem of the specific disqualification imposed on him by the Inspector General’s Office. Another odd fact has to do with investigator Jairo Salazar Medina who in 1988 was functioning as a lieutenant in the Army in Barrancabermeja. There, on January 15 of that year, non-commissioned army officer Francisco Pérez assassinated USO union leader Manuel Gustavo Chacón Sarmiento for which he received a 16-year prison sentence. And the killer’s immediate superior officer when these events took place was Jairo Salazar Medina.

El Tiempo newspaper on March 6, 1992 published as criminal news the report that Mr. Jairo Salazar Medina had been removed from the National Army for mismanaging a revolving fund. Another paradox: This subject kept on with his functions as a member of the CTI of the National Attorney General’s office. It was he who pushed ahead with the investigation against me and was quite unfit to do so.

What remains clear here is a triangle from the ‚Äúcriminal underworld‚ÄĚ where evil doing brings these three personalities together to elaborate a set-up and cost me a whole life of defending human rights. They utilize the lie as their favorite weapon and they trample truth underfoot. ¬†It‚Äôs very clear I was convicted without proofs and all due to an unlawful interest in having me in prison in order to remove me from the public scene as a defender of human rights.

I have publically insisted, and with all respect, that the relatives of engineer David N√ļ√Īez Cala who was basely murdered, have every right to demand and know the truth so that justice that is due, and founded on the truth, might be applied to this unpardonable crime - not the faked truth, the false truth, as orchestrated by a criminal prosecutor like William Gildardo Pacheco Granados and by false witnesses like the confessed criminal Mario Jaimes Mej√≠a, alias ‚ÄúEl Panadero.‚ÄĚ Among other things, it‚Äôs also fully proven that this subject from prison ordered the kidnapping and violation of the distinguished journalist Jineth Bedoya. This was an atrocious act that he never confessed in the Justice and Peace process; that is to say, he lied, as is his custom.

Furthermore, he has a criminal process ongoing now on account of his having ordered from prison the assassination of the rector of the 26th of March School in Barrancabermeja. There are so many other facts demonstrating the capacity of this subject for lying that the Prosecutor surely knows of his modus operandi.

This faked process is full with an ocean of lies; it‚Äôs been said against me that there exists ‚Äúan extensive body of evidence.‚ÄĚ That‚Äôs false, totally false: there only exists the declarations from the two false witnesses; these are the supposed ‚Äúproofs.‚ÄĚ There is nothing else. On the contrary, the broadest possible evidence exists, documents and testimony alike, establishing my innocence.

In a perverse way, they are trying to question my activity as a defender of human rights as they assert: ‚ÄúDavid Ravelo, supposed defender of human rights never had threats against him nor did he do anything that brought any risk onto himself.‚ÄĚ This is a mean-spirited, deceitful affirmation that disregards the collective memory of the community of Barrancabermeja where I dedicated a big part of my life to defending human rights. That was evident when on September 9, 2009, the present writer was awarded the order of San Pedro Claver of the Diocese of Barrancabermeja for a life entirely dedicated to the defense of human rights.

With tenacity and dignity, defying the risk and overcoming the affronts, I have resisted all the persecution I have been subjected to for defending the noble cause of human rights. To these liars I throw back at them the words of the philosopher Lucio Anneo S√©neca, who affirmed, ‚ÄúMany lie to deceive and others because they are deceived.‚ÄĚ

I have always said that the stem of truth bends but never breaks. The moment will come in which the truth is going to watch over all that macabre scheme and put the role of false witnesses into evidence, because, among other things, the Attorney General of the Nation himself has introduced charges for procedural fraud together with false testimony against the false witness Mario Jaimes Mej√≠a alias ‚ÄúEl Panadero.‚ÄĚ The Attorney General thus verified that this criminal lied in the proceedings in my case.

On the most recent February 9, of this year, the Ninth Criminal Circuit Court of the city of Bucaramanga endorsed the accusation presented by the Specialized Third Prosecutor of the National False Witnesses Unit. An exhaustive examination had been made of testimonial evidence from Luis Orrego, Pedro Gilberto Ni√Īo Pardo, Jorge Valencia, Orlando Noguera, Fernando Barbudo Ch√°vez, and Jes√ļs Villamizar Rodr√≠guez. Through their testimonies they explained how the crude set-up had been hatched. Therefore, the innocence of David Ravelo Crespo and Jos√© Ar√≠stides Andrade is demonstrated absolutely.

It was shown that the only two ‚Äútestimonial proofs‚ÄĚ against me are false. Now what legal reasons are there for the present writer to keep on being imprisoned for a crime he never committed?

But it‚Äôs also necessary to mention that the criminal prosecutor William Gildardo Pacheco Granados was linked criminally to the process by virtue of the forced disappearance of the youth Guillermo Hurtado Parra, in particular by the sixth and seventh Specialized Prosecutor who ruled on forced disappearance as a crime against humanity. So it‚Äôs clear that this ‚Äúregular judge‚ÄĚ who sent me to prison lacked jurisdiction to do so because he was unqualified. He was the one who directed the entire set-up against the present writer, creating all this tangle of lies in order to imprison me unjustly.

I will keep on utilizing all possible petitions nationally and internationally (e. g. the Inter-American Human Rights Commission of the OAS) in order to make clear my full innocence and keep on telling the national and international community that in spite of the torment I have been subjected to, I continue with my head high. And from prison I am fulfilling my activities I have carried out all my life as a defender of human rights. To exercise that noble and praiseworthy activity in this country entails taking on risk. I will continue to do so. And I am sure that at the end of the road, the light of truth will shine with all its brilliance. We will overcome the ignominy to which I have been subjected, because the truth surely will make me free.

(Translator‚Äôs note) Colombia‚Äôs Law of Justice and Peace, enacted in 2005, provided for paramilitary leaders receiving sentences of eight years or less in return for confession of crimes and demobilization. Judicial decisions subsequently allowed leaders to be prosecuted further if confessions were incomplete or criminal activities continued. Reportedly, ‚ÄúEl Panadero‚ÄĚ was seeking to implicate David Ravelo to gain favor and thereby avoid a longer sentence.

En el mes de junio del a√Īo 2007, el periodista Gerardo Reyes del Diario Miami Herald, me llam√≥ de Estados Unidos y me habl√≥ de un video donde aparec√≠a el presidente √Ālvaro Uribe V√©lez, reunido en Puerto Berr√≠o (Antioquia) con varios paramilitares de Barrancabermeja, me hizo llegar el video y me inform√≥ que hab√≠a hablado con varias personas y ninguna se atrevi√≥ a denunciar ese hecho. A mediados de junio de ese mismo a√Īo denunci√© esa reuni√≥n secreta ante los medios de comunicaci√≥n a nivel nacional; a partir de ese momento se desat√≥ contra el suscrito una feroz persecuci√≥n.¬†

El 11 de febrero de 2008, la MAPP (OEA), me informó que un comando paramilitar, me estaba haciendo seguimiento para asesinarme; el gobierno me solicitó que abandonara Barrancabermeja, hecho que rechacé porque el Estado es quién debe garantizar la protección y garantía de los Derechos Humanos a los ciudadanos y a los defensores de Derechos Humanos. 

El 17 de febrero de 2011, nuevamente la MAPP (OEA) me abordó para prevenirme, ya que tenían la certeza que ese grupo paramilitar iba a atentar contra mi integridad física colocando un artefacto de alto poder explosivo en mi sitio de residencia. Denunciamos el hecho a los organismos a nivel nacional e internacional, viéndome obligado a salir de la ciudad. 

Los asesinos cambiaron de estrategia y parece que desistieron del asesinato f√≠sico y emprendieron la persecuci√≥n para ejercer el asesinato judicial. Es as√≠ como el 17 de abril de 2008, en la c√°rcel de Itag√ľ√≠ (F√°brica nacional de montajes), el delincuente confeso Mario Jaimes Mej√≠a, alias ‚ÄúEl Panadero‚ÄĚ, habl√≥ en Justicia y Paz de una falsa reuni√≥n en el a√Īo 1991, supuestamente para preparar la muerte del ingeniero David N√ļ√Īez Cala, donde el criminal plante√≥ que el suscrito hab√≠a participado en la susodicha reuni√≥n con el ex congresista Ar√≠stides Andrade.¬†
